1. The agreement

These terms govern the C:Hub app, website and related support supplied by CustomerHub Pty Ltd, 801 Glenferrie Rd, Hawthorn VIC 3122, Australia (“CustomerHub”, “we”, “us”) to the merchant using the service (“you”). You must have authority to act for the merchant and to install and configure the app for the store.

These terms apply with the subscription approved through Shopify and any applicable written agreement. A signed agreement controls an inconsistency in its subject matter. The Privacy Policy explains information handling; an agreed Data Processing Addendum governs processing on your behalf.

2. What C:Hub provides

C:Hub supplies a configurable customer account experience within your Shopify storefront, with an account Page, optional Panel and supported features. Shopify provides the underlying commerce platform and customer authentication. Availability depends on your Shopify account mode, configuration, permissions, available data and connected apps.

Some account actions or integrations use Shopify or third-party destinations. We do not supply every underlying subscription, loyalty, return or invoice service shown through an integration. Demo stores contain sample data and may disable live saving, payment or integration actions.

3. Plans, trials and billing

Charges, billing frequency and trial terms are those presented and approved through Shopify or an applicable written order. Published plans use the store’s total Shopify customer count, rather than active account users. Prices are in USD unless stated otherwise; taxes and connected-app fees may be additional.

All base plans include the full B2C offering. B2B is an optional add-on at US$19 per month or US$190 per year with annual billing, and is the only separately charged C:Hub feature. Fees charged by Shopify or third-party apps are separate. Selecting B2B in the website calculator only changes the estimate; it does not activate the feature or authorize billing.

The standard advertised trial is 14 days, subject to eligibility and the trial shown when you approve the subscription. Reinstallation does not guarantee a new trial. Annual plans are charged for the approved annual period. Changes requiring a new billing approval are subject to Shopify’s billing process.

Review your approved subscription for renewal, plan changes and charges already incurred. The pricing page is a guide and does not authorize a charge different from the subscription you approve.

4. Your store and customer responsibilities

You are responsible for your store, products, fulfilment, customer service, return policy and the account content and actions you enable. Keep app configuration and integration credentials appropriate to your store, and test important customer flows after material changes.

You must have the necessary rights and lawful basis to supply customer information, configure custom fields and use integrations. Provide appropriate customer notices and obtain consent where required. Do not collect sensitive information or confidential documents through C:Hub without a suitable written arrangement and safeguards. A tag-based visibility rule is not a security permission system.

5. Acceptable use and intellectual property

Use the service lawfully. Do not attempt unauthorized access, interfere with other stores or the service, submit malicious content, misuse personal information, or use the service to violate another person’s rights.

You retain your rights in your customer data and account content. You authorize the processing and use needed to provide, secure and support the configured service. CustomerHub and its licensors retain rights in the app, website and related software. Your subscription grants use of the service for the authorized store while the agreement continues; it does not transfer ownership of the software.

6. Shopify and connected services

You must maintain the Shopify and third-party services needed for the features you choose. Their availability, permissions, fees and terms are governed by their own agreements. A supported integration does not mean every feature of that app is available within C:Hub or that all actions remain on your storefront.

We may update C:Hub to respond to platform changes, security issues and product development. We will use reasonable efforts to explain material changes that affect normal use. Any separately agreed service commitments continue to govern their subject matter.

7. Cancellation, suspension and refunds

You may cancel by uninstalling C:Hub through Shopify. Turning off an account display is not the same as uninstalling or cancelling the subscription. Charges already incurred and the treatment of the current billing period remain subject to Shopify billing and applicable law.

Except where required by law or agreed in writing, we do not provide change-of-mind refunds for a used or commenced subscription period. This does not exclude a refund or other remedy required by consumer law.

We may restrict or suspend access where reasonably necessary to address unlawful use, a material breach, security risk or non-payment. Where practicable, we will give notice and an opportunity to resolve the issue. Immediate action may be needed for a serious security or legal concern.

After termination, service access ends and the parties’ data-handling obligations continue as applicable. Uninstalling does not delete your Shopify customer or order records. Retention, return and deletion must follow the applicable privacy obligations and agreed processing arrangements.

8. Availability and rights that cannot be excluded

We aim to provide a useful and reliable service, but do not promise uninterrupted operation, compatibility with every theme or app, or a particular sales or support outcome. An uptime or response-time commitment applies only where expressly agreed.

Nothing in these terms excludes, restricts or modifies a guarantee, right, remedy or liability that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. Any disclaimer or limitation below applies only to the extent permitted by law.

9. Liability

Subject to rights and liabilities that cannot be limited by law, neither party is liable to the other for indirect or consequential loss arising from the service. Subject to the same qualification, CustomerHub’s aggregate liability connected with the service is limited to the fees paid for it in the three months before the event giving rise to the claim.

These limitations do not apply to fraud, wilful misconduct or liability that applicable law does not permit the parties to limit. Any applicable mandatory remedy or separately agreed liability term takes priority.

10. Changes, disputes and contact

Material changes to these terms will be communicated with reasonable notice before taking effect, except where urgent legal or security changes require a different approach. You may stop using and uninstall the service before the new terms apply, subject to charges and rights already accrued.

Victoria, Australia law governs the agreement, subject to any mandatory law that applies. The parties submit to the courts of Victoria, without removing rights to use another competent court or regulator where mandatory law provides them. Contact us first so we can try to resolve a dispute.
